You are hereby notified that a hearing has been scheduled regarding the violations listed below, located at 1271 Alligator Point DR.

Unless otherwise authorized by law or permit, it is prohibited for any person to dump litter or solid waste in any manner or amount; to wit:
1. In or on any beach, public highway, road, street, alley, or thoroughfare, including any portion of the right-of-way thereof, or any other public lands: except in containers or areas lawfully provided therefor. When any litter is thrown or discarded from a motor vehicle, the operator or owner of the motor vehicle or both shall be deemed in violation of this section.

Unless otherwise authorized by law or permit, it is prohibited for any person to dump litter or solid waste in any manner or amount; to wit:
2. In or on any freshwater lake, river or stream or tidal or coastal water of the county, including any bay or gulf contiguous to the shoreline of Franklin County, Florida. When any litter is thrown or discarded from a vessel; the operator or owner of the vessel, or both, shall be deemed in violation of this section;

Unless otherwise authorized by law or permit, it is prohibited for any person to dump litter or solid waste in any manner or amount; to wit:
3. In or on any private property, unless prior consent of the owner has been given and unless the dumping of such litter will not cause a public nuisance or health hazard or be in violation of any other state or local law, rule, or regulation.

Unless otherwise authorized by law or permit, it is prohibited for any person to dump litter or solid waste in any manner or amount; to wit:
4. Yard Trash and Yard Debris are not litter within the meaning of this ordinance, provided that said trash and debris are placed by the landowner on the land from which the said trash and debris originate.

1975-07  Property does not meet zoning requirments.

NOTICE OF HEARING BEFORE MAGISTRATE: This is your notice to appear on November 05, 2026 at 1:30 P.M. for a hearing on the ordinance infraction before Magistrate Cole Davis in the courtroom located at 66-4th Street (Fort Coombs Armory), Apalachicola, FL 32320.

NOTICE OF POSSIBLE FINES AND LIENS: See page two of Policies and Procedures.

Failure to appear at the hearing as above required and requested may result in the entry of an order against you without any further notice.

The hearing room is handicap accessible; however, those persons who may require special assistance to attend the hearing must plan in advance by calling deputy clerk Jessica Gay at 850-653-8861, x100 at least five business days in advance of the hearing.

Any person who may desire to challenge the outcome of the hearing is responsible for recording a verbatim transcript of the meeting.
